TERMS AND CONDITIONS

In these booking conditions “You” or “Your” means the person named in the confirmation invoice. “We” or “Us” means Logan House Estate Ltd, The Estate Office, Wilkin House Farm, Uppertown, Ashover, Derbyshire, S45 0JD.

Please read these Terms and Conditions carefully before making your booking.

CONTRACT

When you submit a request to book a holiday cottage via our website we will respond to you as quickly as possible with details of availability and the price. This does not form a contract between us. Your booking is subsequently confirmed by a confirmation email once the deposit has been paid and this forms the contract. This contract is governed by Scottish law and jurisdiction.

The property you book is let for the purposes of a holiday let to which section 12 (2) and paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988 apply. The booking agreement confers the right to occupy the accommodation for the agreed period only. You undertake to use the property solely for its purpose as self-catering accommodation and to accept our right to refuse access to the accommodation to any person, whether the client/hirer or guest of the client/hirer, deemed unsuitable.

RESERVATIONS & DEPOSITS

The reservation is only confirmed when you have paid a deposit of 50% of the total cost. The booking contract is between you, the client/hirer, and Logan House Estate Ltd. The deposit is taken at the time of booking if booked over 6 weeks in advance. The balance is payable 6 weeks prior to your arrival date.

If the balance of any rental is not paid by the due date, the booking will be treated as cancelled. Any bookings within 6 weeks of arrival must be paid in full at the time of booking.

Subject to availability, changes to the length of your stay can be made up to 48 hours before the day of your arrival.

Any difference in price will be charged as extra to the original booking.

Prices are inclusive of VAT and are subject to change if the rate of VAT changes. VAT No: 467 2409 76. VAT invoices can be provided on request.

CANCELLATION POLICY & REFUNDS

Any cancellation made by you, the client/hirer, for any reason must be made in writing by letter or email directly to Logan House Estate Ltd, Logan House, Ardwell, Stranraer, DG9 9ND

If you wish to cancel, please notify us as early as reasonably possible. Cancellations must be notified to and received by us in writing, preferably by email, in order to be effective and, once received, we will confirm and process your cancellation request.

You can cancel until 14 days before check-in for a full refund.

If you cancel between 7 and 14 days before check-in, but after the 24-hour cancellation period, you will receive a 50% refund.

If you cancel less than 7 days before check-in no refund will be given.

If we are able to re-let any of the dates of your booking, we will refund you according to the value of the replacement booking(s). This value may be less than you have paid if, for example, a replacement booking was discounted or was for a shorter period. In the event of a refund being available, it will be paid to you within 7 days of the date on which the full payment is received from the replacement booking. We reserve the right to charge £50 to reflect the administration cost of re-marketing and this would be deducted from your refund.

You are strongly advised to take out travel insurance with a reputable provider before booking to cover your booking. Any insurance should ideally cover you, your guests and pets for the total cost of your booking. It is your responsibility to check that your insurance cover is sufficient for your own purposes and any likely risks that may affect you or your holiday.

TRANSFERRED BOOKING

There will be a fee of £25.00 for any transferred booking, and bookings may not be transferred within two months of the visitor’s holiday. A transferred booking is from one property to another or from one date to another. The transfer must also be of equal or greater value. If it is not, no refund of the difference will be made. If the transfer is of greater value, the difference will be charged to you and must be paid before arrival.

CANCELLATION BY LOGAN HOUSE ESTATE LTD

Logan House Estate Ltd will endeavour to make sure that the property you have chosen is available for the dates contracted. In the very unlikely event that the property becomes unavailable and Logan House Estate Ltd has to cancel the booking, we will endeavour to find you a suitable alternative property.

If there is nothing available, we will give you a full refund. Logan House Estate Ltd shall only be liable to return the monies received. No compensation or consequential losses shall be paid.

ARRIVAL & DEPARTURE

Guests are welcome to arrive from 3pm.

In order that the property can be thoroughly cleaned and prepared for the next guests, we ask that you vacate the cottage by 10am.

On departure, you are requested to leave the accommodation in a clean and tidy condition. This includes washing up, dishwasher can be left running, placing rubbish in bin-liners, and putting in outside bins or central refuse area, ensuring ovens are clean and free from grease.

We reserve the right to make a charge of £75 for extra cleaning if the accommodation is not left in a satisfactory condition.

OCCUPANCY

The number of persons occupying the property must not exceed the maximum number stated on the booking. If we find that more people than agreed are using the property, this will be considered a breach of contract and you and your party will be asked to leave immediately without any refund.

You, as the person making the booking, will be responsible for all members of your party. You, as the person in charge of your party, must be at least 18 years of age at the time of the booking.

NOISE, NUISANCE & BEHAVIOUR

Logan House Estate is a private farming estate with some residential and some holiday properties. If you or your guests should cause a nuisance or disturbance to neighbours or any other unreasonable behaviour Logan House Estate Ltd may ask you and your guests to leave.

CARE OF THE PROPERTY, DAMAGES & BREAKAGES

You are responsible for the property and we ask you to take all reasonable care of its furniture, pictures, fittings and effects, in or on the property. We expect you to leave them in the same state of repair and in the same clean and tidy condition at the end of the rental period as you found them at the beginning. We ask that you leave the property secure if you leave it unoccupied during the period of let.

You must not use the properties for any dangerous, offensive, noisy, illegal or immoral activities or do anything that may be a nuisance or annoyance to the guests of any other holiday properties or the residents of Logan House Estate.

We understand that accidents happen and we ask that any breakages or damage, accidental or otherwise, are reported to Logan House Estate, details of how to do this are found in the welcome folder in each property. Failure to do this may result in you being charged for any breakages or damage. Any missing inventory from the property on your departure may also be charged for, as may extra cleaning.

COMMERCIAL ACTIVITIES

Guests must not use Logan House Estate Ltd cottages for commercial activities.

DOGS

Dogs are welcome to all our properties. We do ask that they are house-trained, kept under proper control and not allowed on the furniture or beds. They must not be left unattended in the property unless they are crated and unlikely to cause a noise disturbance. Dog hairs are to be removed from carpets and furnishings. All dog waste must be collected and disposed of before you leave.

Dog owners will be held responsible for any damage caused to the property, contents or garden by their dog and if any extra cleaning is required. You agree and accept that this will incur an additional charge of £75 payable within 7 days of your departure.

When you are out walking within the property grounds and estate, you must ensure that your dog(s) are kept under close control and on a lead. They must not be allowed to disturb people, horses, livestock, deer, game birds, hens or ground-nesting birds.

ELECTRIC VEHICLE CHARGING

There is an EV charger located in the car park of Logan Botanical Gardens, a pleasant five minute walk away.

The charging of EV’s via a standard domestic plug or any adaptor is strictly forbidden and guests must not use extension cords to charge vehicles from their property. Failure to comply will result in additional charges and termination of your booking without any refund.

FIREWORKS AND CHINESE LANTERNS

Fireworks are not permitted, Sky Lanterns are expressly forbidden as they are a fire hazard and can cause death or injury to livestock.

SMOKING AND VAPING

Smoking and vaping are not permitted in any of our properties and a flat fee of £500 will be charged if there is any evidence of smoking or vaping within the property.

FLYING OF DRONES

Flying of drones on the Estate is not permitted.

LIABILITY

Logan House Estate Ltd will not be held responsible for any loss or damage to guests’ personal property, vehicles etc. whilst visiting or staying on the Estate.

CHILDREN

Guests must accept responsibility for the safety of their children at all times whilst staying at Logan House Estate, walking on the grounds and visiting the gardens.

All children, a person under 16 years of age, must be accompanied by an adult and must be supervised by an adult at all times.

There are children living on the Estate and care must be taken on all internal roads at all times.

TRAVEL COTS & HIGHCHAIRS

We have a limited number of these that we can provide for your use. Please try to request these at the time of booking to avoid disappointment. Linen and bedding for travel cots are not provided and we do not provide stairgates.

MOBILE PHONES

Mobile phone signal can be hit and miss on the Estate. Where possible please enable your phone to use Wi-Fi calling and use the property’s internet connection.

INTERNET ACCESS

Internet access is provided for your use in all cottages. You agree to reasonable and lawful usage of this service.

We cannot guarantee that internet access will always be available. Any damage to the infrastructure caused by the weather, for example, may take a while to repair and is entirely the responsibility of the internet service provider and is out of Logan House Estate Ltd’s control.

No refunds or compensation will be offered or paid should there be no internet access.

OPEN FIRE & WOOD BURNERS

One of our holiday properties has a log burning stove and you will be supplied with logs, replenished free of charge, and a starter supply of firelighters. All the properties have independent modern heating systems and do not depend on the fires for heating.

SEVERE WEATHER

During severe weather, there is a chance that power cuts will occur. As the repair and restoration of the electricity supply is out of our control, we cannot guarantee when it will return, and no refunds or compensation will be offered or paid.

COMPLAINTS

Every endeavour is made to ensure your stay with us is memorable for all the right reasons. However, we do recognise that from time-to-time, things do go wrong. In these circumstances, it is your responsibility to make any such problems known to Logan House Estate Ltd as soon as it becomes apparent, giving us the opportunity to correct the situation, and rest assured, we will make every endeavour to do so as soon as reasonably possible. Unless this procedure is followed, no subsequent claim will be entertained.

CIRCUMSTANCES BEYOND THE CONTROL OF THE OWNER (FORCE MAJEURE)

If, for any reason, we have to cancel your booking in advance due to circumstances beyond our control, for example fire, flood, exceptional weather conditions, epidemics, pandemics, destruction/damage to the property “force majeure” you will be refunded the full amount of the booking.

If we have to terminate your holiday early for the above reasons you will be refunded part of the booking fee based on the time remaining of the booking. This will be the full extent of the liability of Logan House estate Ltd. No additional compensation, expenses or costs will be payable.

DISTRUPTION

Logan House Estate Ltd will not be liable to you, any member of your party or person visiting the property during the period of your hire of it for happenings outside its reasonable control, such as breakdown of domestic appliances, plumbing and water, wiring, temporary invasion of pests, damage resulting from exceptional weather conditions or other unforeseeable circumstances.

RIGHT OF ENTRY

We shall be allowed reasonable right of entry to the property at all reasonable times for purposes of inspection, in cases of emergency or to carry out any necessary repairs or maintenance.

ACCURACY OF DETAILS

The website is as accurate as possible but cannot be warranted, nor do the descriptions form any contract. Whilst every effort is made to ensure accuracy of property descriptions and images, the facilities and services may alter. We reserve the right to alter or improve any of the subjects without notice.
